Terms and Conditions
The terms that govern access to and use of Beseam's website and ecommerce visibility services.

These Terms and Conditions ("Terms") govern access to and use of the websites, applications, audits, monitoring, recommendations, publishing tools, reports, integrations, and other services provided by Beseam ("Beseam", "we", "us", or "our") (together, the "Service").
By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility and authority
The Service is intended for business use. You must be at least 18 years old and legally capable of entering into these Terms.
If you use the Service for a company or other organization, you confirm that you have authority to bind that organization. In that case, "you" and "your" refer to both you and the organization.
2. The Service
Beseam helps ecommerce teams understand and improve how products appear across storefronts, feeds, search results, and AI-assisted shopping or recommendation surfaces. Features may include:
- checking customer buying questions across supported AI and search services
- auditing product, catalog, feed, price, inventory, and storefront information
- identifying visibility gaps and generating findings or recommendations
- monitoring products and recording changes over time
- publishing changes that you approve and, where supported, retaining information needed to revert them
- providing reports, alerts, integrations, and related support
Features may differ by plan, integration, geography, or availability. We may improve, replace, or discontinue features in accordance with Section 11.
3. Accounts and integrations
You must provide accurate information and keep it current. You are responsible for protecting account credentials and for activity under your account. Tell us promptly at contact@beseam.com if you suspect unauthorized use.
You confirm that you own or are authorized to act for every store, domain, account, feed, and integration you connect or submit. You authorize Beseam to access and process the relevant data and to take the actions you request through the Service.
You are responsible for configuring permissions appropriately, reviewing proposed changes, and approving any action that writes to a store or third-party platform. A revert feature does not replace your own backups or change-management procedures.
Third-party platforms and integrations are also governed by their own terms. We are not responsible for changes, restrictions, outages, or decisions made by those providers.
4. Your content and data
"Customer Content" means information, data, URLs, product content, prompts, instructions, files, and other material you submit, connect, or make available through the Service.
You retain ownership of Customer Content. You grant Beseam a worldwide, non-exclusive, limited license to host, copy, transmit, process, modify, and display Customer Content only as reasonably necessary to provide, secure, support, and improve the Service and to meet our legal obligations.
You confirm that you have all rights, permissions, and lawful bases needed for Beseam to process Customer Content as described in these Terms and our Privacy Policy. Do not submit confidential credentials in free-text fields or sensitive personal data that is not required for the Service.
Publicly accessible store and product information may be collected and analyzed as part of the Service.
5. Acceptable use
You must not:
- use the Service unlawfully or in a way that infringes another person's rights
- access or submit a store, account, or data without authorization
- upload malware or harmful, deceptive, discriminatory, or illegal content
- probe, scan, or test the Service for vulnerabilities without our written permission
- bypass security, authentication, usage limits, or access controls
- interfere with the Service or impose an unreasonable load on it
- use undocumented automated means to scrape or extract the Service or its outputs
- reverse engineer or attempt to discover source code or non-public algorithms, except where applicable law does not allow this restriction
- copy, resell, sublicense, or commercially exploit the Service except as expressly agreed with us
- use the Service or its outputs to build, train, validate, or improve a competing product or model without our prior written permission
- misrepresent AI-assisted output as verified fact or use it to make unlawful decisions about individuals
We may investigate suspected misuse and suspend access where reasonably necessary to protect the Service or others.
6. AI-assisted and third-party output
The Service may query or rely on third-party AI, search, commerce, and data providers. Their responses may be incomplete, inaccurate, delayed, unavailable, or different from results shown to other users. Coverage and output can change without notice.
Findings, recommendations, scores, forecasts, and generated content are provided to support your judgment. They are not legal, tax, financial, or regulatory advice and do not guarantee traffic, ranking, inclusion, revenue, or any particular commercial result.
You are responsible for reviewing outputs, testing changes, maintaining backups, and deciding whether a recommendation is suitable for your products, customers, and legal obligations.
7. Fees and orders
Some Service features are free and others are paid. Pricing, usage limits, subscription periods, payment terms, and any special commitments will be shown at purchase or set out in an order form, statement of work, or other written order (an "Order").
You must pay applicable fees and taxes in accordance with the Order. Except where an Order or mandatory law says otherwise, fees are non-refundable. A subscription renews only if the applicable Order says that it renews.
If an Order conflicts with these Terms, the Order controls for that conflict.
8. Intellectual property
Beseam and its licensors own the Service, including its software, design, documentation, trademarks, and underlying technology. Except for the limited right to use the Service under these Terms, no rights are transferred to you.
Subject to these Terms and any applicable Order, Beseam grants you a limited, non-exclusive, non-transferable, non-sublicensable, and revocable right to use the Service for your internal business purposes during the applicable service period.
If you provide feedback or suggestions, you allow us to use them without restriction or payment. We will not identify you publicly as the source without permission.
9. Privacy and confidentiality
Our Privacy Policy explains how we handle personal data.
Each party may receive non-public information that is marked confidential or that a reasonable person would understand to be confidential. The receiving party will use that information only for the relationship, protect it with reasonable care, and disclose it only to people who need it and are bound by appropriate duties. This obligation does not apply to information that is public through no breach, already lawfully known, independently developed, or lawfully received from another source.
A party may disclose confidential information where legally required after giving notice when permitted.
10. Availability and beta features
We aim to provide a reliable Service, but we do not guarantee uninterrupted or error-free availability. Maintenance, security events, provider outages, or circumstances outside our control may affect the Service.
Features identified as preview, beta, experimental, or similar may be changed or withdrawn at any time and may be less reliable than generally available features.
11. Changes to the Service or these Terms
We may change the Service to improve it, address security or legal requirements, or respond to third-party platform changes. If a change materially reduces a paid feature during an agreed service period, any remedy will be determined by the applicable Order and mandatory law.
We may update these Terms from time to time. We will post the updated Terms and change the date above. If a material update affects an active paid Service, we will provide reasonable notice where practicable. Continuing to use the Service after the updated Terms take effect means you accept them.
12. Suspension and termination
You may stop using the Service at any time. Cancellation and end-of-term rules for a paid Service are set out in the applicable Order.
We may suspend or terminate access if you materially breach these Terms, fail to pay amounts due, create a security or legal risk, or use the Service in a way that could harm Beseam, the Service, or others. Where reasonable, we will give you notice and an opportunity to remedy the issue.
When access ends, your right to use the Service ends. Sections that by their nature should survive will remain in effect, including Sections 4, 6, 8, 9, 13, 14, 16, and 17.
13. Disclaimers
To the maximum extent permitted by law, the Service and all outputs are provided "as is" and "as available." Beseam disclaims all express, implied, and statutory warranties, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and availability.
Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.
14. Limitation of liability
To the maximum extent permitted by law, Beseam will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, business opportunities, goodwill, or data, arising from or related to the Service.
To the maximum extent permitted by law, Beseam's total aggregate liability arising from or related to the Service will not exceed the fees you paid to Beseam for the Service in the 12 months before the event giving rise to the claim, or CHF 100 if you paid no fees.
These limitations do not apply to liability that cannot be limited under applicable law. Your rights under mandatory consumer law, if applicable, are not affected.
15. Events outside our control
Neither party is liable for delay or failure caused by events beyond its reasonable control, including internet or utility failures, natural disasters, labor disputes, government action, cyberattacks, or outages of third-party platforms.
16. Governing law and disputes
These Terms are governed by Swiss law, excluding its conflict-of-law rules and the United Nations Convention on Contracts for the International Sale of Goods.
The courts of Zürich, Switzerland have exclusive jurisdiction over disputes arising from or related to these Terms or the Service, unless mandatory law requires a different forum.
17. General terms
These Terms and any applicable Order are the entire agreement concerning the Service and replace earlier discussions or agreements about the same subject.
You may not assign these Terms without our prior written consent. Beseam may assign them as part of a merger, reorganization, financing, or sale of all or part of its business.
If a provision is unenforceable, it will be adjusted only as much as necessary, and the remaining provisions will continue in effect. A failure to enforce a provision is not a waiver. Headings are for convenience only.
